Once they get your response, it will be added to your case and delivered to the officer who issued the RFE. He/she will then make a decision on your case. If at that time your PD is not current, your case can not be approved even if it is approvable, but will be sent to on hold, waiting for your PD to be current.

There is no way that she can start working from April. If her H1B is approved, the earliest she can start working will be Oct 1, 2007. Also, make sure that her H1B is filed ASAP because the 20,000 MS quota has also been seen to evaporate pretty quickly (~1-2 months).
In other words, she will have to convince her employer to allow her to start from October.

Hi All...
My attorney filed my EAD (mailed) on August 28 this year and last Friday I saw the approval too on USCIS site. Today I decided to help one of my friends with his EAD so I decided to pull the attorney filed copy of my I-765, I noticed that attorney had mentioned "AOS" in Q:15 instead of H1B. I am on H1B and I have never used my EAD... so I am worried now and I don't know what are my options now... Would you please take few minutes of your precious time and help me with the options I may have now to correct this issue?

In response to the major delays with Labor Condition Applications (LCA's), the USCIS announced a temporary policy and procedural change regarding H1B petition filings. Effective November 5, 2009, H1B cases can be filed prior to the certification of the required Labor Condition Application (LCA). This change was necessitated by delays in LCA processing through the Department of Labor (DOL).
Here is how the new process will work. USCIS will begin to accept H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) petitions filed with uncertified LCAs for a 120-day period, commencing November 5, 2009 and through March 4, 2010. However, USCIS will only accept such H-1B petitions if they are filed at least 7 calendar days after the LCAs were filed with DOL and include evidence of these filings. The only acceptable evidence of filing is a copy of DOL�s email giving notice of receipt of the LCA.
Petitioners who seek to take advantage of this temporary flexibility in the normal filing procedures for H-1B petitions must wait until they receive a request for evidence (RFE) before they submit the DOL-certified LCA to USCIS in support of the H-1B petition. USCIS will give petitioners a period of 30 calendar days within which they must send in a DOL certified LCA in response to the RFE. My wife did her MBA and used her OPT before marriage. After a gap of OPT period she again went to school and got a MS degree. During her OPT, she did not work at all. Now she is unable to get second OPT for her recent MS degree.
Is there a way out to get second OPT? Can this new law (29 months OPT) if passed, be used to apply for second OPT.
What should be best approach? Please advice.

A student can get an OPT once for every level of education. Since your wife already had an OPT at the "master's" level (it does not matter whether she could earn money during that period or not), she can only get another if she goes for a Ph.D. After completing the Ph.D., she will get one more OPT.
I do not know how the new law, if passed, will be "grandfathered", but I doubt if it can be used for your wife's case.

Hello All,
I have a certain queries regarding the transfer from L2 to H1B.
My husband is on L1 and me on L2 with my EAD still under processing. However my husband's firm wants to get his visa converted to H1 which automatically cancels my L2 status and I would have to apply for H4.
So now my query is for how long will his status of L1 be valid will it be till the start date of H1B, or the minute he files in his papers for H1B or when his H1B gets approved?

ask to see if ur company can support the original GC application also. If they will provide you documentation that you mention in the 3rd point you should be fine.
Your company attorney's should be able to guide you more.
I think this is no different that using an EAD to switch jobs. You can continue working on H1B also - provided your company sees no need to file amended H1B .

1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?

You are not mandated to report on AC21 (job change) so my advice is not to report it till USCIS ask's you.
For address change. Yes you need to report that. But if you can retain your current address for just this one month and perhaps commute (fly) to your new job you can take a chance. Just my advice
